Terms of contract
How we work, what each service includes and what you can expect when you contract with us.
Last updated:
Purpose and scope
These terms apply to the services The Nimbus Studio provides to its clients: web development, maintenance, IT support, automation and marketing. Who is behind the business is stated in the legal notice .
Each assignment is set down in writing in a proposal or quote. Where the accepted proposal says something different from these terms, the proposal prevails.
This website sells nothing and charges nothing: no service is contracted by visiting the site, asking for a quote or sending a form.
Services and scope
The scope of each service is the one described in the accepted proposal and, for the plans, the one published on the pricing page at the time of contracting.
What is not expressly listed as included is not part of the service. We offer no unlimited work, and we do not guarantee commercial results, sales or search engine positions.
Monthly plans
The monthly plans include the tasks, the time and the quantities stated for each plan.
- The limits of a higher plan replace those of the plan below; they are not added together.
- Minutes, changes and designs that are not used in a month do not carry over to later months.
- A technical assessment may be needed before a plan starts.
Billing and payment
Prices are stated in euros and exclude VAT. The monthly plans are billed monthly in advance.
How and when each assignment is paid is stated in the proposal before work starts.
Duration and cancellation
The monthly plans are contracted month by month and can be cancelled with 30 days of notice, unless agreed otherwise in writing.
To cancel, write to us at info@thenimbusstudio.com .
Additional work
Any work outside the plan or the accepted proposal is quoted separately. We neither carry it out nor bill it without your approval beforehand.
Responsibilities of the client
- To provide in time the access, the content and the information needed to deliver the service.
- To hold the rights to the texts, images and other material handed to us.
- To keep up the payments of the third-party services the project depends on.
- To review and approve the work within a reasonable time.
External providers and hosting
Web hosting is not included in our services. Each client contracts and pays for their hosting directly with the provider of their choice. We can offer technical help with the configuration or connection when it is part of the contracted service.
Domains, licences, paid apps, platform subscriptions and advertising spend are contracted and paid by the client directly, unless the proposal says otherwise. Those services are governed by the terms of each provider, and we are not answerable for their interruptions or changes.
Exclusions
Unless agreed in writing, the following are not included:
- Hosting and domain registration.
- New pages, custom development and complex repairs within a maintenance plan.
- Malware cleaning and the recovery of sites that are already compromised.
- Managing social media, managing campaigns and advertising spend within a creative plan.
- Support or revisions without limit.
Support requests
Sending a support request does not mean that the help is free of charge, nor is it the automatic contracting of a service. Work outside an active contract may have a cost: we tell you the price and ask for your acceptance before doing any paid work.
The reference number of a request identifies that request; it is not a contract number. We do not commit to specific response or resolution times.
Complaints and contact
If something is not what you expected, write to us at info@thenimbusstudio.com or call us on +34 614 133 778. We will look into your case and answer you.
Rights the law gives you
These terms do not limit the rights that the applicable law gives to consumers and users, including, where it applies, the right of withdrawal. If you contract as a consumer, we will tell you about those rights before you contract.
How your personal data is handled is explained in the privacy policy .
Changes to these terms
We may update these terms. Each assignment is governed by the terms in force when its proposal was accepted.
